  The Tragedy:
 

Advocates for Ajay are very sympathetic to true victims of rape and sexual abuse. Among those advocating for Ajay’s innocence are true victims of rape and sexual abuse. We are extremely shaken and profoundly disturbed that one would consciously fabricate a story and continue to lie through trial proceedings, which ultimately destroyed many lives. One of the tragedies of false allegations is that it denigrates the true victims of these horrific crimes. What unfolded in the case of Ajay Dev, a victim of false allegations and wrongful conviction, is a frightening tragedy. The tragedy begins below…

Ajay, a Nepali American Citizen, and his American wife, Peggy, adopted a teenage girl from Nepal in a humanitarian act hoping to give her a better education, a better life and hoping that after she was established, she would help her biological family in Nepal and others if the opportunity arose. The problems began when the fairly new parents and their young adult adopted daughter of 3.5 years conflicted over priorities – college and career vs. boyfriends and her social life. Yes, the age old conflict.

Inexperienced and well intentioned, Ajay and Peggy tried to keep her focused on education. However, the young woman believed they were overly involved in her life. Over the next 1.5 years numerous arguments ensued over priorities and responsibilities. Eventually, after just such an argument and feeling hopeless in their ability to get her on track, Ajay and Peggy asked her to move out of their home.

Although she was over 20 at the time, Ajay and Peggy promised her biological family they would take care of her. She had not yet finished college and they felt obligated to inform her biological parents of her misbehavior and asked for their help. The young woman interpreted Ajay’s communication to her biological father as an infringement on her freedom, and the argument escalated into an accusation of physical abuse. Shocked, hurt and saddened by her accusation, Ajay and Peggy withdrew all financial support (they had previously paid for everything (cell phone, car, education, etc.). Angered by what she perceived as another infringement on her freedom; and fearful of having to return to a country and a lifestyle she no longer desired; as well as being worried about having to be held accountable for her misbehavior, the accusation then escalated from physical abuse to one of sexual abuse.

   
 
How an innocent man was wrongly convicted.
1.

Detective Mark Hermann, who was more concerned with making a case than validating a claim of sexual abuse, did not question pertinent witnesses. Rather than take a hard look at the inconsistencies found within her story, he validated his case by covering up any inconsistent statements and misrepresented facts and evidence to the jury.

Deputy DA Steve Mount’s reputation is to push weak cases. Knowing her testimony was very weak, he charged Ajay with 92 counts and tacked on accusations relating to porn and dissuasion in an attempt to prejudice the jury. Even though at the preliminary hearing the Judge stated the evidence was very weak it was allowed to go to trial because you only need probable cause (someone to say it happened). At trial DDA Steve Mount was able to keep exculpatory evidence out and grossly misrepresented the facts to the jury.

92 Counts - in Yolo County there is a pattern of minority defendants having a ridiculously high number of counts stacked-up against them compared to similar cases with white defendants. The large number of counts prejudices people into believing the defendant must be guilty – otherwise, why would the DA’s office go forward with so many counts?

Motivation for pushing weak cases and stacking up counts to get a conviction - the DA's office receives federal grant money which is directly tied to the number of prosecutions and convictions for sex crimes – CASH FOR CONVICTIONS.

Naturally, people are very sympathetic with true victims of rape and molestation. However, this creates an inherent prejudice towards somebody accused of these types of crimes. Most people don’t realize that up to 40% of rape claims are false (False Rape Accusations May Be More Common Than Thought - Wendy McElroy ). Unfortunately it has taken a lot of work by the Innocence Project which has exonerated 254 people as of June 8, 2010, for people to start to realize the short comings of the legal system – www.innocenceproject.org
