The Fabrication vs. The Truth: Porn
   
 

The accuser claimed Ajay showed her porn/child porn:

  The jury found Ajay not guilty. Computer forensic expert witness testimony revealed the following.
     
  1. The accuser described one video and claimed it was shown to her in early 1999 (while in 9th grade Feb. '99 - June '99) on the defendant's laptop computer.
    - The movie wasn't created until 2000, as revealed by the movie producer.
    - The defendant's laptop did not exist in 1999. It was purchased brand new in November 2001 (almost 3 years later), confirmed by credit card, purchase and shipping receipts. As well as forensic analysis of the computer.
    - The movie was found on the accuser's computer. It was not put there until Aug. 2003 as revealed by the police forensic analysis.
     
  2. The porn/child porn was on the accuser's computer, which was located in her room.
    - It was put on the accuser's computer in August 2003 (she was in college and dating). This was only a few months before her adopted parents asked to move out in December 2003 due to the problems they were having with her.
    - The forensic evidence proved that both Ajay and Peggy were not at home, but physically at work when someone accessed the porn/child porn on the accuser's computer in her room.
    - It was never accessed after the accuser moved out in December 2003.
     
  3. The accuser was 20 years old, in college and dating at the time the porn appears on her computer.
    - Trial testimony revealed that the accuser had dated two young men (names withheld) from November 2002 to December 2003.
    - One of the young men was seen entering and leaving the Dev home while Ajay and Peggy were at work. The neighbor's testified that the front room curtains would be drawn when the man entered and then be reopened after he left.
    - The other young man testified that he was having sexual relations with the accuser at the time she lived in the Dev house.
     
  4. When the forensic evidence came back catching the accuser in a lie, Deputy DA Steve Mount tried to discredit his own police forensic investigation, characterizing it as "so called science".
     
  If someone is telling the truth they do not need to lie.
